Once you have made payment of either the Deposit or the Rental in full, this confirms you and your group agree to abide by these Terms and Conditions, including any variations agreed by email.

and is referred to here as the ‘Owner’

Ben Wilson is the Representative of Motovunska Bastina d.o.o.
and is referred to as the ‘Representative’

The Guests (you) are referred to as the 'Client’


The Client undertakes to read this Agreement carefully.

When the Client’s booking is made via an agent (the ‘Booking Agent’) such as Booking.com or Airbnb.com, the Booking Agent’s terms and conditions will take precedence over this Agreement in all matters concerning the booking, cancellation and payments only.

Conditions applying when the Client makes the booking directly with the Owner:

Reservations: At most times the Representative will be able to hold the Client’s booking open for a few days pending confirmation. This will enable the Client to make their arrangements, such as booking flights etc. without being obliged to proceed with the booking.

Payment: As per the Invoice, this Payment secures the booking and also confirms the Client’s acceptance of these terms and conditions.

Cancellation: If the Client needs to cancel or amend the booking, they must contact the Representative as soon as possible. Unless different terms (such as a longer free cancellation period) have been agreed by email between the Representative and Client, a cancellation will only be valid and be repaid in full (but less any bank charges):
(a) When the Representative receives written notification of cancellation by email and
(b) Subject to that notification being received not less than 60 days prior to the arrival date of the rental

If the Client cancels the booking less than 60 days before the date of the rental, then all money received by the Owner will be retained by the Owner, unless the Owner & its Representative manage to find another Client, in which case the money will be returned in full, but less any bank charges and any differences in price between the Clients booking and the New Clients booking.

Changes of booking dates: If the Client wishes to change their dates after having agreed the booking, the Owner will endeavour to accommodate this, but this will be subject to having at least 60 days’ notice, and subject to availability and the Client paying any extra costs should the new requested dates be at a more expensive time of the year.

Method of Payment: Payments can only be accepted and made by bank transfer, as the Owner is not equipped to take card payments or cash.

Arrival and Departure Times: Check-in: from 4pm and Check-out: by 10am.

Additional energy costs: Pool heating (if required and normally only outside of July & August) is charged at an extra 150 euros per week. Due to the size and the depth of the pool the Client will need to allow between 24-48 hours for the water to heat up, but if requested we will organise this prior to the guest’s arrival. It is unlikely that clients will require the pool to be heated during the summer months of July & August. When the Pool heating is in operation between October and May, the Owner would be grateful if the automatic cover is activated at night to reduce the costs & conserve energy.

Extra services, such as babysitting and a private chef are charged at cost.

Villa Angelo is only allowed to have 2 cars parked for free at the top of Motovun, either in the blue boxes on the main road or in the visitors parking lot beneath the cemetery (between 100m and 500m from the front door of Villa Angelo and depending on availability). Should our guests have more than 2 cars, then please let us know in advance and we will try to organise parking for the other vehicles, which will be charged to you at cost. I am afraid guests cannot park next to the property, as the local regulations state this is only for permanent residents of the town.

Gas and electricity: Gas and electricity for the general running of the house is included in the price, but the electrical supply can be limited due to the demand and infrastructure in Motovun, particularly during thunderstorms where it can sometimes stop working for short periods of time.

Air conditioning is available in all of the bedrooms and the Owner kindly requests that clients turn off air conditioning when the bedrooms are not in use.

Wireless Internet: Free Wi-Fi is available at the property, but due to the infrastructure in Motovun being rather poor and being badly affected during thunder and rain storms, it can occasionally cut out and be rather slow for which the Owner cannot be held responsible.

Force Majeure: There are certain things that are outside the Owner’s control and they do not accept any responsibility for any damage or loss as a result of “force majeure”. This means an event beyond the Owner’s reasonable control, which could not be foreseen or avoided, including but not limited to: strike, lock-out, labour dispute, act of God, war, riot, civil commotion, malicious damage, compliance with a law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, snow and storm, difficulty or increased cost in obtaining workers, goods or transport and other circumstances affecting the supply of goods or services.

The Owner cannot be held responsible for the breakdown of mechanical equipment such as pumps, boilers, swimming pool filtration systems, nor for the failure of public utilities such as water, gas and electricity; but undertake to repair such breakdowns as soon as is reasonably possible.

Complaints: Every effort is made to ensure that clients have an enjoyable holiday. If however, the Client has any cause for complaint it is important that remedial action is taken as soon as possible. It is essential that the Client should contact the Representative or the House Manager as soon as a problem arises, so that it can be speedily resolved.

Change in Conditions: The prices and booking conditions supersede all those previously published. Prices and booking conditions may be updated, changed with the exception of confirmed bookings for which payment has been made.

Applicable Law: This Agreement is governed by Croatian Law, but any differences between the parties to this agreement should be settled by amicable agreement, failing which arbitration or litigation in accordance with Croatian law will apply.

The Client’s obligations:

To use the property at your own risk, and waive any claim you/they may have against the Owner or Representative, arising from any injury which you may suffer directly or indirectly as a result of using the property.

To behave in a proper manner and to be responsible for the actions and behaviour of all members of the group who are staying at, or visiting the property during the rental period.

To keep and leave the property and the furnishings, bedding and towels clean and in good condition.

To ensure that the number of persons staying in the property does not exceed 8 persons, in accordance with the Owners rental licence.

To ensure that towels, blankets or linen remain at the property, other than the brown swimming towels which are for the beach, as well as the pool.

Not to remove any protective mattress covers from the beds.

To be responsible for making sure that children and all members of the group are aware of any dangers in the house, garden, pool, steam room or local vicinity.

Not to hold large-scale events or parties at the property without prior approval from the Representative.

To report any breakages or other problems to the Representative or House Manager at the earliest opportunity. The Owner understands that breakages happen, but should be informed at the earliest opportunity in order that it can be rectified for the next Guests. Breakages will be treated on a case-by-case basis, and costs, repair or replacement will be charged to the Client when appropriate. In the case of damage, the Owner will take into account normal wear and tear and minor mishaps, but they will inform the Client of the final cost of more serious damage during the Checkout or as soon as possible after the Client’s departure. The Client will be responsible for paying for serious damage or items missing within 30 days.

To be responsible for any parking fines they may receive in Motovun during their stay.

To use the swimming pool and steam room entirely at your ‘The Client’s’ own risk. (Due care and attention should be paid at all times and of course children must always be supervised. The Owner cannot be responsible for any accidents in the Pool or throughout the rest of the property other than problems caused by the Owner’s negligence. )
To not allow any persons to the pool, steam room or garden other than those registered to stay in Villa Angelo during their specific rental period, or close family and friends of the Client.

To not allow any diving or jumping into the pool from the terrace/s above.

To not allow Pets on the outdoor beds or furniture, or in any of the communal facilities, such as the swimming pool or steam room.

To not allow any kind of glass drinking vessels or containers near the pool, as breakages within the pool often necessitates the emptying & refilling of the pool which can take 7 days.

To not allow any persons under 16 years of age to use the both the steam room and pool, other than when accompanied by an adult who shall be responsible for that person’s conduct at all times.

To turn off the Steam room when not in use.

Not to access the Plant room with the Pool technical equipment, as if a problem arises, then the Representative or House Manager should be notified immediately, and they will rectify it as soon as possible.

To take adequate travel insurance to cover all eventualities including sickness. For residents of the European Union, it is also advisable to apply for a European Health Insurance Card (EHIC) before travelling. This should give the holder rights to access healthcare free of charge in Croatia and other European Union countries whilst on holiday. The EHIC does not cover all medical costs or repatriation to the Client’s home country, so Clients would be well advised to take out adequate travel insurance. It is usually possible to apply for the EHIC online, free of charge – so Clients should check with the Department of Health in their own country for further information.
